Terms of Service

1. Acceptance of Terms

By creating an account or using FieldMind, you agree to these Terms of Service. If you do not agree, do not use the platform. These terms apply to all users, including individuals and companies.

2. Description of Service

FieldMind provides a suite of field management tools for construction superintendents, including but not limited to: AI-powered submittal review, daily reporting, RFI tracking, punch list management, safety and defect logging, and scheduling tools. Features may be added, modified, or removed at any time.

3. AI-Powered Submittal Reviewer

The Submittal Reviewer uses artificial intelligence to compare uploaded documents against reference specifications. By using this feature, you acknowledge and agree that:

• AI output is advisory only and does not replace the judgment of a licensed design professional
• Review decisions (SUBMIT, PENDING, RESUBMIT) are suggestions, not formal engineering or architectural approvals
• You are responsible for verifying AI output against project documents before taking action
• FieldMind LLC is not liable for any project outcomes, delays, defects, or disputes arising from reliance on AI-generated reviews
• Uploaded documents may be processed by third-party AI providers (Anthropic) subject to their privacy policies

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized access. You may not share accounts or allow others to use your credentials.

5. Subscription and Billing

FieldMind is offered on a subscription basis. A 14-day free trial is available to new accounts. After the trial period, continued access requires a paid subscription. Subscriptions are billed monthly and may be canceled at any time through the billing portal. No refunds are issued for partial billing periods.

6. Data and Privacy

FieldMind stores data you enter including project information, reports, logs, and uploaded documents. You retain ownership of your data. We do not sell your data to third parties. Project documents uploaded for AI review are transmitted to Anthropic's API for processing and are subject to Anthropic's data handling policies. You should not upload documents containing personally identifiable information beyond what is necessary for submittal review.

7. Acceptable Use

You agree not to use FieldMind to upload unlawful content, attempt to reverse engineer the platform, interfere with other users, or violate any applicable laws or regulations. We reserve the right to terminate accounts that violate these terms.

8. Limitation of Liability

FieldMind LLC is not liable for any indirect, incidental, special, or consequential damages arising from use of the platform, including but not limited to project delays, cost overruns, contract disputes, or losses resulting from AI-generated output. Our total liability to you for any claim shall not exceed the amount you paid us in the three months preceding the claim.

9. Disclaimer of Warranties

FieldMind is provided "as is" without warranty of any kind. We do not warrant that the platform will be uninterrupted, error-free, or that AI output will be accurate or complete. Use of the platform is at your own risk.

10. Changes to Terms

We may update these terms at any time. Continued use of FieldMind after changes are posted constitutes acceptance of the updated terms. We will notify users of material changes by email.
